Terms of Service

These Terms of Service ("Terms") govern your use of the Cup Cup app, operated by Cup Cup LLC ("Cup Cup," "we," "us"). By using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. The service

Cup Cup lets you browse a menu, customize and place pickup orders from a Cup Cup location, and optionally join the Cup Cup Club loyalty program. Payment is currently pay-at-pickup only; the app does not process online payments today.

2. Your account

Cup Cup issues every device an anonymous sign-in session automatically; no sign-up with an email or password is required to place an order. Joining Cup Cup Club attaches your first and last name and loyalty profile to that session. Checkout separately requires a name and phone number. You may choose supported sign-in methods shown in the app to link or recover an account. Available methods depend on platform and release configuration.

You may permanently delete your account at any time from More → Delete account inside the app. See our Privacy Policy for exactly what is deleted and what is retained. Deletion is final and cannot be undone by us on your behalf.

You are responsible for the accuracy of the name, phone number, and other information you provide, and for keeping your device secure since it holds your sign-in session.

3. Orders and pickup

  • Orders are for pickup only at the location you select; Cup Cup does not offer delivery today.
  • Prices, item availability, and preparation times are as shown in the app at the time of ordering and are subject to change.
  • Payment is due at pickup.
  • Cancellation: you may cancel an order before preparation starts, directly in the app. Once preparation has started, cancellation or refund is at Cup Cup’s discretion.

4. Cup Cup Club loyalty program

  • Membership is free and optional.
  • Under the current tier rules, Member earns 3 Cup Cup Points per 100 AMD (3%). Regular earns 5 per 100 AMD (5%) from 50,000 AMD of lifetime qualifying spend; Master earns 7 per 100 AMD (7%) from 100,000 AMD; and Legend earns 10 per 100 AMD (10%) from 300,000 AMD. Points and qualifying spend are credited only after an order is completed and actually paid.
  • Tier status is based on net completed, actually-paid, loyalty-eligible AMD spend. Redeemed or free value does not create qualifying spend. The order that crosses a threshold retains the tier rate snapshotted when it was created; the next order uses the new tier.
  • Each Cup Cup Point has a redemption value of 1 AMD. Points may be used only for complete eligible items when the balance covers the item’s full configured price. Points and AMD cannot be split on the same item, and redemption is never automatic.
  • Cancelled or refunded orders may restore redeemed points and reverse points previously earned and corresponding qualifying spend. A refund can lower tier status and uses the refunded order’s original earning-rule snapshot. A reversal may create a negative balance if those earnings were already spent.
  • Cup Cup may change future earning or eligibility rules prospectively. Historical transactions retain their original rule version and legitimate existing loyalty value will not be silently removed.
  • Deleting your account permanently forfeits access to unredeemed points — see our Privacy Policy, Section 7.

5. Acceptable use

You agree not to misuse the app, including: attempting to forge, replay, or tamper with loyalty or redemption codes; attempting to access another customer’s account or order; or interfering with the app’s normal operation. Cup Cup may investigate suspected abuse using the retained security/anti-fraud records described in our Privacy Policy, and may suspend or refuse service in response to confirmed abuse.

6. Intellectual property

The Cup Cup name, logo, and app content are owned by Cup Cup LLC or its licensors. You may not use them without permission.

7. Disclaimers

The app and the Cup Cup service are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be excluded under applicable law. We do not warrant that the app will be uninterrupted, error-free, or available at all times, or that item availability, pricing, or preparation times shown in the app will always be perfectly accurate.

8. Limitation of liability

To the fullest extent permitted by applicable law, Cup Cup LLC’s total liability to you for any claim arising out of or relating to the app or these Terms is limited to the amount you paid for the order giving rise to the claim, and Cup Cup LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

9. Changes to these terms

We may update these terms from time to time. If we make a material change, we will update the "last updated" date at the top of this page. Continued use of the app after a change means you accept the updated Terms.

10. Governing law and disputes

These Terms are governed by the law of the Republic of Armenia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the app that cannot be resolved informally is subject to the exclusive jurisdiction of the competent courts of the Republic of Armenia, in Yerevan.
